Setting GHG emission quotas: the CJEU upholds the Commission’s rejection of the appeal lodged by two NGOs

The Court of Justice of the European Union (CJEU) has upheld the Commission’s rejection the request by the two NGOs, Global Legal Action Network and CAN Europe, to review an implementing decision setting the annual greenhouse gas emission quotas for the period 2023-2030, according to a judgment handed down on 2 September 2026.

The NGOs’ action for annulment argued that this decision was based on “insufficient emission reduction targets, particularly in light of the Paris Agreement, and on an impact assessment marred by several shortcomings”.
