FR / PFAS: a levy due for 01/09/2026; publication of the 28 substances (Official Journal)

The list of the 28 substances, the procedures for determining them and the conditions for applying the reduction in the case of treated polluted water under the PFAS water pollution levy are set out in a decree of the French Prime Minister, as well as by an order of the Ministry for Ecological Transition, Biodiversity and International Negotiations on Climate and Nature dated 25 June 2026 and published in the French Official Journal on 27 June 2026.

The levy applies where the annual discharge exceeds 100 g of PFAS per facility. The rate is set at €100 per 100 g of PFAS discharged, subject to inflation adjustment. This applies to facilities classified as requiring environmental protection (ICPE) and subject to authorisation, whose activities result in the discharge of PFAS into water, either directly into the natural environment or via a public or private collection network (wastewater treatment plants, etc.).
