Taxonomy: several associations lodge an appeal to "re-examine a delegated regulation" issued by the EU

An appeal to the European Court of Justice, lodged by several environmental associations opposed to the development of wind power, was published in the Official Journal of the EU on 16/02/2026.

Through this appeal to the Court of Cassation, the appellants are challenging a judgment of the European Court of First Instance of 10/09/2025. In its rejection of the action for annulment, the Court confirmed the European Commission's rejection, in 2022, of their request for a review of a delegated regulation supplementing the so-called "taxonomy" regulation.

In their initial request, the associations argued in particular "that the said delegated regulation does not demonstrate that the economic activity of producing electricity from wind energy makes a substantial contribution to the environmental objectives referred to in that delegated regulation".

In fact, as part of the taxonomy regulation (unified classification system for sustainable activities), this delegated regulation establishes technical examination criteria. These help to determine whether a given economic activity - in this case…
