The ENVI Committee rejects the PfE objection to the Commission's implementation of the CBAM

The ENVI Committee of the Parliament rejected the objection to the Commission implementing regulation laying down rules for the application of the Carbon Border Adjustment Mechanism, and especially the methods for the calculation of emissions embedded in goods, on 28/01/2026, during an ordinary session in Brussels. 56 members voted against, 25 in favour and no abstentions.

This objection has been submitted by Marie-Luce Brasier-Clain (Patriots for Europe). According to her, "although there is a three-year test phase, the Commission had to react urgently by publishing a large series of implementing acts. These measures are far from sufficient: they are circumstantial and temporary and do not seek to challenge the logic of the CBAM".

Maria Lena Scoppio, the European Commission's Director for Indirect Taxation and Tax Administration (DG TAXUD), said: "We strongly disagree with the claim that the Commission has exceeded its implementing powers. The Act was prepared in close cooperation with the Commission's Legal Service, and we are confident that it complies fully".
