FR / Energy efficiency: decree sets out the transposition of EU Directive 2023/1791

Decree No. 2025-1382 of 29/12/2025, published in the Journal officiel on 30/12/2025, sets out how the measures in Directive 2023/1791 of the European Parliament and of the Council of 13/09/2023 on energy efficiency are to be implemented in France.

It defines how energy efficiency and energy sobriety assessments must be carried out for major projects, plans, and programmes, in particular as part of environmental assessments. It also specifies how these assessments are to be reflected in the reports of the French energy regulator (CRE / Commission de Régulation de l'Energie), as well as in energy audits and energy management systems.

The decree also details how heating and cooling action programmes are to be integrated into local climate-air-energy plans. It sets out the rules for conducting cost-benefit analyses and the requirements for monitoring the energy performance of data centres.

Finally, it amends provisions of the Energy Code on data relating to the transmission, distribution, consumption, and production of electricity and gas, with the aim of facilitating data collection.
