FR / Batteries: introduction of penalties for non-compliance with Regulation (EU) 2023/1542

A decree published in the French Official Journal on 29/10/2025 transposes into French law Regulation (EU) 2023/1542 on batteries and waste batteries intended for consumers. It establishes the penalties applicable in cases where operators fail to comply with European requirements related to durability, safety, labelling, health and lifespan information, as well as the recycling, collection, and treatment of waste.

Regulation (EU) 2023/1542 requires Member States to establish a system of penalties for infringements of its provisions. The decree amends the French Consumer Code to enable the sanctioning of operators who fail to comply with these rules.

The decree includes the provisions of articles 77 and 78 of the regulation within the scope of penalties. These articles provide for the introduction, from 18/02/2027, of a "digital battery passport" in the Member States.
