EC: launch of three consultations on key CBAM features to prepare permanent regime on 01/01/2026

The European Union has launched consultations on three key initiatives under the Cross-Border Carbon Adjustment Mechanism (CBAM), on 28/08/2025. These involve the preparation of implementing acts that will define the rules for applying CBAM in its final form from January 1, 2026.
The consultations, open to all stakeholders for four weeks from 28/08/2025 on, cover three areas:
•clarification of the methodology for calculating embedded carbon emissions in goods,
•the rules for taking into account free allowances in the EU ETS ,
•the procedure for reducing CBAM certificates if a carbon price has already been paid for the product in the country of origin.

According to the European Commission, "these acts have economic and environmental effects. They will provide legal certainty for businesses, reduce the risks of carbon leakage, promote global decarbonisation and support the competitiveness of the EU internal market".
