EC: infringement decision for 26 Member States due to failure to promote renewable energy in law

The European Commission issued an infringement decision on 26 out of 27 Member States as they failed to transpose the promotion of renewable energies into their national law, on 24/07/2025. All EU Member States received the letter, except for Denmark, which complied with EU law.

"The European Commission decided to open infringement procedures by sending letters of formal notice to 26 Member States for failing to communicate the full transposition of the provisions of the amending Directive (EU) 2023/2413 into national law, which was adopted in 2023. Member States had to notify the transposition of the Directive by 21/05/2025, except for some provisions related to permitting, which were already due by 01/07/2024. To date, only Denmark has notified full transposition of the Directive by the legal deadline", it says.

An infringement decision is the first formal step of warning the EU Commission can issue, before issuing a reasoned opinion and, if Member States still don't comply, it will then go to the Court of Justice of the EU. The 26 Member States have two months to reply and…
